This Privacy Policy describes how Niagara Winery Weekly (the “Site”, “we”, “us” or “our”) collects, uses and discloses your personal information when you visit or use the Site, sign up for our emails, enter a contest or giveaway, or otherwise communicate with us regarding the Site (together, the “Services”). For the purposes of this policy, “you” and “your” mean you as a user of the Services, whether you are a subscriber, a website visitor, an advertiser or another individual whose information we have collected.

Please read this policy carefully. By using or accessing any of the Services you agree to the collection, use and disclosure of your information as described here. If you do not agree, please do not use or access the Services.

Changes to this policy

We may update this policy from time to time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised policy on the Site, update the date above, and take any other steps required by applicable law. Continuing to use the Services after a change means you accept the updated policy.

How we collect and use your personal information

We collect personal information about you from a variety of sources, set out below. What we collect and how we use it varies with how you interact with us.

In addition to the specific uses described below, we may use information we collect to communicate with you, to provide and improve the Services, to comply with applicable legal obligations, to enforce our terms of use, and to protect or defend the Services, our rights, and the rights of our users and others.

Information we collect directly from you

Information you submit to us directly may include:

• —Entry information, if you enter a contest or giveaway, which may include details required by the rules of that contest and by the platform running it.

We may automatically collect certain information about your interaction with the Services (“Usage Data”). To do this we may use cookies, pixels, tags, local storage, software development kits and similar technologies (“Cookies”). Usage Data may include device information, browser information, information about your network connection, your IP address, approximate location derived from it, the pages and listings you view, the links you follow, and other information about your interaction with the Services.

Information we obtain from third parties

We may obtain information about you from third parties, including vendors and service providers who collect information on our behalf, such as:

Any information we obtain from third parties is treated in accordance with this policy.

How we use your personal information

Providing the Services

To operate the Site, send you the emails you have asked for, run and administer contests and giveaways, respond to you, and provide the features you use.

Marketing and advertising

To send marketing and promotional communications by email or other channels, to show you advertising, and to tailor the Services and advertising on this Site and on other websites. This may involve sharing information with advertising and marketing partners.

Measurement and reporting

To measure how the Site, our emails, our advertising and our featured placements perform, and to report on that performance to advertisers and partners.

Security and fraud prevention

To detect, investigate and act on possible fraudulent, illegal or malicious activity, and to protect the Services.

Communication and improvement

To respond to you, provide support, and improve the Services, which is in our legitimate interest in running and developing the business.

Cookies

Like many websites, we use Cookies on the Site. We use them to operate and improve the Site and the Services, including to remember your actions and preferences, to run analytics and better understand how the Services are used, and to measure and deliver advertising. We may also permit third parties and service providers to use Cookies on the Site to better tailor the services, products and advertising you see here and on other websites.

Most browsers accept Cookies automatically, but you can set yours to remove or reject them through your browser controls, and mobile devices offer controls for advertising identifiers. Removing or blocking Cookies may affect your experience and may cause some features to work incorrectly or become unavailable. Blocking Cookies may also not completely prevent information being shared with third parties such as our advertising partners.

Where the law requires your consent before non-essential Cookies are set, we will ask for it. We recognise the Global Privacy Control (GPC) signal: if your browser sends it, we will treat that as a valid request to opt out of the sale or sharing of personal information, and of targeted advertising, for that browser or device. We do not respond to other “Do Not Track” signals.

How we disclose personal information

We may disclose your personal information to third parties in a number of circumstances, including:

• —In connection with a business transaction such as a merger, acquisition, financing or insolvency; to comply with legal obligations, including responses to subpoenas, warrants and similar requests; to enforce our terms of use; and to protect or defend the Services, our rights and the rights of our users and others.

We are not in the business of selling personal information, and we do not auction, rent or publish subscriber lists. Some privacy laws define “sale” and “sharing” broadly enough to cover disclosing information to advertising, analytics and marketing partners for targeted advertising, even where no money changes hands — and some of the disclosures described above may fall within those definitions. The categories involved would be contact details such as an email address, and Usage Data such as the pages and listings you have viewed. Where the law gives you a right to opt out of it, you may do so by writing to us or by using the Global Privacy Control signal described above.

Third party websites and links

The Site links to websites and online platforms operated by third parties, including winery websites, booking and ticketing services, contest platforms, social networks and mapping services, and it uses map tiles supplied by OpenStreetMap. If you follow links to sites we do not control, you should review their privacy and security policies and their terms. We do not guarantee and are not responsible for the privacy or security of those sites, or for the accuracy, completeness or reliability of information found on them. Our inclusion of a link does not by itself imply any endorsement.

Children’s data

The Services concern licensed wineries and alcohol, are intended for people of legal drinking age in Ontario, which is nineteen, and are not intended to be used by children. We do not knowingly collect personal information from children. If you are the parent or guardian of a child who has given us personal information, contact us using the details below and we will delete it.

Security and retention

We take reasonable steps to protect the information we hold, but no security measure is perfect or impenetrable and we cannot guarantee perfect security. Information you send to us may not be secure in transit, and we recommend you do not use insecure channels to send us sensitive or confidential information.

How long we retain your personal information depends on a number of factors, including whether we need it to provide the Services, to comply with legal obligations, to resolve disputes, or to enforce our agreements and policies. If you unsubscribe, we retain enough information to ensure you are not added again in error.

Your rights

Depending on where you live, you may have some or all of the rights below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

Access

To ask for access to the personal information we hold about you, including how we use and share it.

Correction

To ask us to correct information that is inaccurate.

Deletion

To ask us to delete personal information we hold about you.

Portability

To receive a copy of your personal information and, in certain circumstances and with exceptions, to ask us to transfer it to a third party.

Opting out of sale, sharing or targeted advertising

To direct us not to sell or share your personal information, or to opt out of processing for targeted advertising as defined in applicable law. Visiting the Site with Global Privacy Control enabled is treated as such a request for that browser or device.

To appeal a decision if we decline a request, by replying to our response.

Communication preferences

To opt out of promotional email at any time using the unsubscribe link in any message. If you opt out we may still send non-promotional messages, such as those concerning a contest you entered.

You may exercise these rights by contacting us using the details below. We will not discriminate against you for doing so. We may need to collect information from you to verify your identity before responding substantively. You may designate an authorised agent to make a request on your behalf; before accepting such a request we will require proof that you have authorised them, and we may need to verify your identity with you directly. We will respond within the time required by applicable law.

Complaints

If you have a complaint about how we process your personal information, please contact us using the details below. If you are not satisfied with our response, you may have a right to appeal our decision by contacting us again, or to complain to the Office of the Privacy Commissioner of Canada at priv.gc.ca or to your local data protection authority.

International users

We may transfer, store and process your personal information outside the country you live in. Our hosting and database providers store data on servers in the United States, and our service providers and partners may process information in other countries. Personal information held outside Canada is subject to the laws of the country it is in, including lawful access requests by authorities there.
